There are many simple systems that can help people drastically reduce their chances of driving under the influence (DUI) charges. Some people always take a designated driver with them to parties or bars. Others use rideshare services when they know they intend to drink.
Some people who enjoy craft beers, fine wines or specific cocktails may drink regularly and may therefore have an increased need to take protective steps. Some of those people might invest in pocket breath test systems. Others might use pay-per-use devices at the bars or restaurants they frequently patronize.
The idea behind these devices is to ensure proactive compliance with the law. People can test themselves to affirm whether or not they are capable of safely and legally driving. Unfortunately, a test conducted before heading home does not automatically protect people from prosecution.
Test results might be inaccurate
Research into pocket breath test systems, including devices that sync with mobile phones, shows a varying range of reliability. Some devices were inaccurate as often as they were accurate, meaning they produced questionable results roughly half of the time.
Even moderate inaccuracies in blood alcohol concentration (BAC) readings could be the difference between facing DUI charges and getting home safely. If a device underestimates a driver’s BAC by 0.02%, that can be enough to put them at risk of arrest and prosecution. Factors including the way that people administer the test, how recently they calibrated the device and even underlying medical issues can impact the accuracy of test results.
BACs may continue rising
It is important for people to understand that their BAC is not static after they finish drinking. It takes some time for the body to metabolize the alcohol. People may see their BACs continue rising for half an hour or longer after they finish drinking.
If people test too quickly after consuming their last beverage, they could have much higher test results if police officers pull them over 20 minutes later. While personal breath test devices can reduce the risk of a DUI charge, they do not eliminate the possibility of getting arrested.
Mounting a rigorous DUI defense strategy can help people avoid convictions that could cost them their driving privileges and cause a cascade of significant consequences. Motorists accused of impairment may need help evaluating the situation to decide how to respond, and that’s okay.
